 SHORT SALE HOW TO -

Here is an email I sent to a new client, a "to-do" list to get started putting up your home for a Short Sale:

Please be aware that with a short sale, there are Negotiator fees to pay of $995 flat that either buyer, seller or the agents involved will need to pay at Escrow. Generally the Sellers Agent and Buyers Agent will split these fees, to be paid out of their commissions at time of sale. Please review these forms that need to be filled out by Seller, Sellers Agent, buyers and buyers agent. We will want Attorney's Title to handle all of our Title reports, Escrow and Negotiations....as needed, see the Title companies main page at: www.attorneystitlewa.com then click on Forms & Rates, then Short Sale Negotiation Forms link at; www.attorneystitlewa.com/forms.asp 

 
Sellers ONLY... need to review, sign/date and return forms seen at: www.attorneystitlewa.com/Standard_package.pdf    about 27 pages of info, but we only need the signed pages back.
 
Sellers and their Agent (Hopefully Don Leske II) plus Buyers and their Agent... need to also review and then sign & return forms at: www.attorneystitlewa.com/ProfessionalSvcsAgt.pdf only 8 pages, we only need back the signed or marked pages.
 
Then there is the actual Listing Agreement itself. I will fill it out ..then the sellers will need to review and make any changes or updates they feel are important or needed..., then sign/date or initial as seen and return all pages back to me.
 
Please know that this can be a 4-6 month process all in all and there is no guarantee of a sale, of course.
They may find that if they call their Lender, that they will be told that they must be 2 or 3 months behind before they will negotiate at all. So, if they see that this is true then they would need to stop making payments if they have not already done so by now. Call me today.

NOTICE:
    1. There is often a "fee" normally required when a 3rd party Short Sale Negotiator is hired or required by seller to assist in such a sale. The seller, wheather the home owner or Lien Holder, may require such assistance to facilitate or help the process. The BUYER may be required to pay half or all of such a fee. Here is the NWMLS (MLS) rule on that:

2. Short Sale Negotiators – Rule 11(b)(vii)    /  updated here on September 8th, 2010.

          Similar to the auction issues, NWMLS has received numerous complaints and questions about short sale listings where the seller expects the buyer to pay a third party short sale negotiator. Selling agents and buyers are often caught by surprise when, after submitting an offer, the seller delivers a counteroffer that obligates the buyer to pay a fee to a third party. 

          To eliminate that surprise, new Rule 11(b)(vii) requires the listing member to disclose in the Agent Remarks if the seller requests that the buyer pay a fee to a third party, the amount of the fee, and the identity of the third party.  The Rule also requires that the listing member submit a “letter on file” from the seller detailing this restriction.  The new Rule provides:

(b)     Restrictions Permitted Only if Signed Seller’s Request is Obtained in Advance. The following restrictions on showing and sale shall be noted in the listing and the listing member must obtain the Seller’s Request before the restriction is imposed. . . .

(vii)     The seller requests that the buyer pay a separate, lawful fee to a third party, such as a short sale negotiator.  The listing must set forth the seller’s request, the amount of the fee, and the identity of the third party.

While this request to pay a fee to a third party will most often relate to short sale negotiators, it also applies to any fee that the seller requests that the buyer pay to a third party.
